Rental regulations for Otium Luxury Apartments

1. General provisions

1. Regulations specify the conditions for the reservation and rental of Apartments placed on the website www.otiumapartments.pl, booking portals and sales by phone or email. Making a reservation is tantamount to reading and accepting the provisions of the Regulations. Making a reservation is also the conclusion of the Apartment Lease Agreement between Otium Group S.C. and the client, on terms specified in the regulations and the price list.
    
2. These conditions for the use of the apartments form an integral part of the apartment rental agreement concluded between the Guest and Otium Group S.C.
    
3. Otium Luxury Apartments, owned by Otium Group S.C. Elżbieta Madej, Paweł Stępień with headquarters at ul. J. Sarego 12/11, 31-047 Kraków being a party to the lease contract, for a holiday, tourist or business stay.
    
4. Apartment - a dwelling, described in detail at the website www.otiumapartments.pl, which the Guest rents for a temporary / daily stay for leisure, tourism or business.
5. Guest - a natural or legal person, will be a party to the apartment rental agreement, being at the disposal of Otium Luxury Apartments.

2. Booking

Our guests can book apartments in the following way:

1. Through the on-line booking system, which is located on the website www.otiumapartments.pl. The reservation receives the status of a guaranteed reservation, after paying an advance in the selected price rate in the amount of min. 30% right away after booking. No booking deposit means cancellation of the reservation.
    
2. By sending an e-mail to book@otiumapartments.pl, sending a request using the contact form or by phone. Then you will receive a special offer along with the cost of your stay and bank details, to which you must pay 30% of the advance payment. The advance payment must be made within 24 hours, so that the reservation receives a guaranteed status. No payment within the given period means cancellation of the reservation.
3. Through booking portals.

An advance paid after the indicated date, restores reservations, as long as Otium Luxury Apartments has an available apartment.

3. Changes in the booking and cancellation policy

1. All changes to the reservation are only allowed through Otium Luxury Apartments employees. The guest informs Otium Luxury Apartments by phone about the range of changes he would like to make. Otium Luxury Apartments reserves the right to refuse booking changes if it is not possible due to objective reasons. In the event of withdrawal from the Agreement due to the inability to amend the terms of the Agreement, the Guest shall not be entitled to a refund of the advance payment.
    
2. No advance payment means cancellation of the reservation.
    
3. n the event of cancellation of the reservation less than 14 days before arrival, the guest is not entitled to a refund of the advance payment.
4. In case of shortening the stay by the Guest in less than 14 days by arrival, there is no refund for unused nights.

4. Changes or cancellation by Otium Luxury Apartments

1. A change of reservation by Otium Luxury Apartments is possible only in case of a force majeure preventing the rental of the apartment by Otium Luxury Apartments. Force majeure is understood as: natural disaster, apartment occupancy by the state authority, strikes, wars, riots and deprivation of the apartment by the supplier: electricity, gas, heating energy or water. At that time, Otium Luxury Apartments will offer you a stay at another time or withdraw from the contract and return the advance paid.
    
2. Otium Luxury Apartments reserves the right to provide, in the event of a breakdown or fortuitous events in the apartment, the provision of a replacement apartment with parameters similar to the reserved apartment. If you do not agree to change the apartment, the contract changes and Otium Luxury Apartments is obliged to refund the advance payment.

5. Payment

The guest can make a payment in one of the following ways:

1. Internet transfer via the payment system on the website www.otiumapartments.pl

2. Direct transfer to Otium Luxury Apartments bank account

3. By means of a payment card - through the payment system on the website www.otiumapartments.pl

6. Prices

1. All prices offered by Otium Luxury Apartments are expressed in PLN and include currently applicable VAT tax.

2. Calculation of amounts due for reserved services takes place in accordance with the price list in force on the date of booking.

3. The fee paid by the Guest includes: applicable VAT tax, tourist fees and end-of-stay cleaning fees (bed sheets, towels, hotel gallantry)

4. Media charges (water, gas, electricity, heating) are included in the cost of your stay.

5. The fee does not include additional services such as: transfer from the airport, additional exchange of bedlinen and towels, stay of an animal, additional cleaning on request.

6. At the Guest's request, Otium Luxury Apartments may issue an invoice, with prior notification of such a wish together with the invoice details.

7. Residence rules

1. Guest is required to notify Otium Luxury Apartments at the time of their arrival at least one day before the date of arrival. Notifications can be made by phone or email.

2. Hotel day begins as a standard at 15:00 on the day of arrival and lasts until 11:00 on the day of departure.

3. Check-in is free.

4. Check-in and key transfer takes place directly in the booked apartment. All details of check-in and handing over of the keys are sent along with the confirmation of the reservation by e-mail by Otium Luxury Apartments employee or agreed by phone.

5. Check-out is carried out until 11:00 on the day of departure.

6. The specific time of departure and return of the keys is determined with the Otium Luxury Apartments employee. The guest is obliged to leave the object in a condition not deteriorated in relation to the state in which it was received.

7. The guest undertakes to operate the apartment in accordance with its intended purpose, not to remove any elements of its equipment and decorations from the apartment, as well as undertakes not to copy the keys to the apartment that were given to him during the stay.

8. The guest is financially liable for any damage or destruction of technical equipment and devices resulting from his fault or people visiting him. In this case, Otium Luxury Apartments reserves the right to charge the Guest with the amount corresponding to the loss suffered and to charge the Guest's credit card for damage caused after his departure or to deduct the equivalent of losses incurred from the deposit.

9. The guest is obliged to secure the apartment each time he / she leaves it by closing the windows and the key door and carefully protecting the key.

10. The guest receives one set of keys to the apartment. If the keys are lost, the Guest will be charged a sum of 100 PLN.

11. The guest is obliged to observe quiet hours, health and safety rules and fire protection of the facility. Between 22:00 and 06:00 it is forbidden to conduct any disturbing rest of the residents. In the event of a justified complaint addressed to Otium Luxury Apartments due to the Guest's behavior in the apartment, the person representing Otium Luxury Apartments has the right to terminate the contract with immediate effect without the obligation to refund the remaining booking period.

12. Guest is obliged not to keep animals in the apartment, unless agreed otherwise with Otium Luxury Apartments.

13. In the event of gross or hooligan violation of the rules set out in these regulations, Otium Luxury Apartments has the right to withdraw from the contract with immediate effect and remove the client along with his accompanying persons assisted by the Police.

14. Otium Luxury Apartments does not bear any legal and civil liability for claims in the event of an accident, injury or death of the Guest or third parties in the apartment during the period of the Guest's stay. Otium Luxury Apartments is fully exempt from such liability.

15. Otium Luxury Apartments is not responsible for any items left in the apartment.

16. During the stay, the number of people staying in the facility may not exceed the number of people indicated in the booking. In the event of violation of this point, Otium Luxury Apartments has the right to terminate the contract with immediate effect, without the obligation to refund the remaining part of the reservation or impose a fine of 200 PLN / day.

17. Otium Luxury Apartments is not responsible for any inconvenience caused during your stay related to: construction or finishing works that can be carried out on the premises in which the apartment is located, and around it, due to reasons beyond the control of media delivery for reasons beyond Otium Luxury (m. in, electricity, water, co), noise emissions from neighboring properties.

18. The apartment is strictly non-smoking - the guest will be charged PLN 300 for breaking it.

19. Prolongation should be reported no later than 14:00 on the day preceding the day of expiry of the period covered by the reservation. Prolongation of stay will take place only as far as available apartments are available. An unreasonable extension of the Guest's departure time is tantamount to payment for the next day.

7. Rental contract

The lease agreement concluded between Otium Luxury Apartments includes only the rental of an apartment. The boarding and organization of the stay is solely the responsibility of the guest.

8. Domestic animals

Otium Luxury Apartments allows the owner to stay with an animal only in selected apartments. The guest bears full responsibility for the damage caused by the animal. The fee for the animal's stay is determined in accordance with the current booking price list.

9. Privacy and cookie policy

1. This policy lays down the rules of processing and protecting personal data which users submit in order to use services provided by Otium Luxury Apartments website (hereinafter referred to as "Website").

2. The controller of personal data processed on the Website is OTIUM GROUP S.C. Elżbieta Madej, Paweł Stępień, Kraków 31-047, Józefa Sarego 12/11, entered into the Business Register under TIN: 6762534111 (hereinafter referred to as "Controller").

3. For reasons connected with personal data safety, the Controller relies on the internal procedures and recommendations compliant with relevant legislation, in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on protection of individuals with regard to the processing of personal data and on the free movement of such data as well as the repeal of Directive 95/46 WE.

4. The Controller protects the interests of data subjects with due care. The Controller in particular ensures that:

   1. the data are collected for specified and legitimate purposes and are not processed further in any way incompatible with the intended purposes,

   2. the data are processed lawfully,

   3. the data are factually correct and adequate to the purposes for which they are processed,

   4. the data are kept in the form which allows for identification of the data subjects for as long as it is necessary for the purposes for which they are processed.

5. Personal data are processed based on the Website's user consent and in the cases where the provision of the law in force authorize the Controller to process personal data.

6. The Controller processes personal data provided by the Website's users voluntarily only for the purpose of:

   1. responding to users' queries sent via contact form,

   2. accepting online bookings,

   3. providing services offered by the Controller under Article 6(1) (f) GDPR,

   4. marketing, including sending commercial information via e-mail if the user has given his/her consent for it by ticking the appropriate box in the booking process or by sending a query via the contact form. The consent for processing personal data for marketing purposes and sending commercial information can be withdrawn by clicking an appropriate link in the received e-mail or by sending a relevant notification to the Controller's e-mail address,

   5. pursuing a legitimate interest of the data Controller in specific cases on the basis of Article 6(1) (f) GDPR, e.g. vindication or visual monitoring of the movements around the facility's premises.

7. Personal data can be used by authorities, institutions, subjects authorized by law, and subjects providing services for the Controller (e.g. subjects providing legal, IT, marketing, and accounting services, as well as other subjects participating in processing of the requested service).

8. The Controller can make use of automated decision-making, including profiling, for the marketing purposes and for the purpose of matching the offer with the users' needs.

9. The Website's user has the right to review data processed by the Controller. The user has the right to have data rectified or erased, as well as to demand restricting or stopping the processing of his/her personal data at any time. The user can also request to have his/her personal data erased from the Website. The right to transfer data shall no apply here since the standards of exchanging such data between hotel facilities have not been established.

10. The Website's user has the right to withdraw his/her consent at any time with without affecting the lawfulness of processing of personal data conducted on the basis of the previously expressed consent to do so.

11. In order to exercise his/her rights as indicated in point 8 above, the Website's user should contact the Controller via e-mail book@otiumapartments.pl using the same e-mail address or telephone number which he/she sent to the Website.

12. Every user has the right to lodge a complaint with the Office for Personal Data Protection.

13. The Controller obtains information on users and their behaviour by:

    1. having user voluntarily fill in the forms,

    2. collecting cookies.

14. Upon the first visit to Otium Luxury Apartments Website, the user is notified of the use of cookies. Staying on the website, the user accepts the use of cookies. Not changing the privacy settings of the user's browser equals giving consent to the use of cookies.

15. Installing cookies is necessary for the proper provision of the Website's services. Cookies contain information necessary for proper functioning of the website, in particular information which require authorization. The user can change the settings of his/her browser relating to using and saving cookies at any time.

16. The Website uses the following types of cookies:

    1. session cookies - erased when the user closes or logs out of the website using cookies,

    2. persistent cookies - remain on the user's browser until he/she erases them or until the predetermined time set out in cookies' parameters.

17. According to the data purpose, cookies can be divided into:

    1. conversion files which enable analysis of the effectiveness of various sales channels,

    2. tracking files which, together with conversions, facilitate analysis of the effectiveness of various sales channels,

    3. marketing files used for personalizing and targeting ads,

    4. marketing files used for personalizing and targeting ads,

    5. analytics tools which help make using the website more comfortable thanks to understanding its users' behaviour,

    6. necessary files which are fundamental for proper functioning of the website's basic elements. Cookies that we use help us develop our website.

18. Some cookies can be used by the website and online booking system owner solely for the purpose of:

    1. improving and supporting bookings,

    2. analysing and collecting statistical data on the use of website and online booking system for the purpose of improving them.

19. The Website can contain links directing to other websites which operate independently of the Website and are not supervised by it. These websites can have their own privacy policy and regulations, which we advise to read carefully.

20. The Controller has the right to change the Website's privacy policy as a result of technological development, possible changes to existing personal data protection laws, and the development of the Website. Users will be notified of such changes in a noticeable and clear way.
